This had far reaching implications beyond what we ever dreamed when we undertook achallenge to Section 401 MS Department of Environmental Quality (DEQ) water quality certification for this dredging project. The MS Supreme Court said the Comm.on Environmental Quality's opinion was inadequate as a matter of law because it did not articulate its reasoning for its decision. This had far reaching implications not just for DEQ, but for all agencies in the state. State agencies now must give reasons for ignoring environmental considerations in projects and permits.

Bond Com In Investing Early in the year the Coast Group challenged Chevron Pascagoula Refinery's so called "Clean Fuels" expansion (attachment Chevron Hearing sh). We hired air quality consultant Alex Sagady of Michigan in order to prepare substantial comments on this expansion project that increased air pollution on the Coast in order to produce low sulfur fuels for use elsewhere in the country. This was the first Clean Fuels project in the country, so it was particularly important for Sierra Club to take a firm stand against a refinery community already suffering from pollution being further impacted in order to produce the low sulfur fuels. This was the first time Chevron's greenwashing had been challenged on the Coast. Among other things we revealed that the oil giant was lying when it said emissions would decrease with this expansion. The club was able through negotiations to improve the permit limitations.

Bond David Guide In Investing The PA General Assembly has passed and Governor Ridge has signed HB 154, which will significantly improve the regulation of All-Terrain Vehicles (ATVs) in Pennsylvania. Thanks to a strong outpouring of support from conservationists and hiking enthusiasts, passage of HB 154 occurred before the legislature adjourned for the summer. The Sierra Club played a leadership role in this effort.

Bond Greensboro Greensboro HB 154, as passed, doubles fines and penalties for ATV violations, requires the display of an ATV registration plate, mandates liability insurance, allows local governments that enforce ATV rules to keep fine monies (incentive to enforce), and creates an advisory committee that includes conservationists to review ATV issues for DCNR. HB 154 also creates a grant program that will use ATV Fund monies for the development of trails on non-state land. This is seen as an important alternative to the development of additional ATV trails on state park and forest land. Governor Ridge signed HB 154 in early summer

Bond Fayetteville Fayetteville The West Virginia Chapter, the Monongahela Group, and local Sierra Student Coalition activists joined with local neighborhood groups, organized labor, and Native American groups to help defeat a proposed Wal-Mart in Morgantown West Virginia. Sierrans participated in a protest march, wrote letters, held numerous meetings, and spoke out in force at hearings. One particular success was a "Tour De Sprawl" event which highlighted both examples of sprawl and examples of Smart Growth in the City, and featured several of the Sierra Club's national Urban Sprawl reports. This attracted media attention and built support with local political leaders who began to recognize the need for more efforts to halt sprawl. Public pressure on the state highway department emphasized traffic congestion and led to a decision to restrict road access. The process culminated in a public hearing for a wetlands permit where EVERY single member of the public who spoke opposed the proposed Wal-Mart development. This helped force the Army Corps of Engineers to request changes that ultimately led to the collapse of the Wal-Mart plan in July 2001. The campaign was a broad coalition effort, and Sierra Club played a major role in presenting alternatives, analyzing impacts, and mobilizing public opposition.
