Environmentalists Cite Threat To State Clean Air Rules

Bond In Investing Savings Environmentalists and state advocates warned yesterday that many states could be forced to abandon plans to reduce unhealthy emissions from off-road machinery under a provision recently adopted by a Senate committee. The provision was designed to prevent California from toughening air pollution standards for lawn mowers and garden equipment, but it could affect other states and equipment as well, the advocates said.

New rules on "trade in services" could force governments to weaken environmental standards for risky industries, such as trucking, logging, mining, water supply, real estate development, factory farming, and more. To comply with NAFTA's rules on trade in services, the Bush administration recently waived US clean air standards in order to allow trucks based in Mexico to haul freight on US highways. This could increase air pollution in border states, as the aging Mexican truck fleet pollutes more than similar US trucks, and do not use the cleaner fuels required in the United States.

Bond (R-Mo.) on behalf of lawn mower engine manufacturer Briggs & Stratton Corp., would alter the Clean Air Act by stripping California and other states of their long-standing authority to exceed federal air quality standards for smaller off-road engines except agricultural and construction equipment.

1. (1) This Order may be cited as the Carriage by Air Acts (Implementation of the Montreal Convention 1999) Order 2002. (2) This Order shall come into force on the day the Convention for the Unification of Certain Rules for International Carriage by Air done at Montreal on 28 May 1999 comes into force or takes effect for the United Kingdom and the Secretary of State shall give notice of that day in the London, Edinburgh and Belfast Gazettes.

Other states, including Alabama, Connecticut, Massachusetts, Nebraska, New Jersey, Pennsylvania, South Carolina, Tennessee, Texas and Wisconsin, are considering a wide range of new restrictions that could be blocked if Congress approves the Bond amendment, state advocates say.

Municipal Bonds Investment The Senate Appropriations Committee approved the Bond amendment Sept. 4 as part of the fiscal 2004 spending bill for veterans, housing and environmental programs. Sens. Dianne Feinstein and Barbara Boxer (D-Calif.) have vowed to fight the amendment when the spending bill reaches the Senate floor this month. The Bush administration has remained neutral regarding the amendment by Bond, who heads the appropriations subcommittee that controls the Environmental Protection Agency's budget.

Bond Terms Trading "There are very far-reaching implications for what Bond is doing because he is making a fundamental change in the Clean Air Act -- and doing it through the back door of the budget process," said Frank O'Donnell, executive director of the Clean Air Trust. "It would not only stop California from setting standards for new lawn mowers, but stop ongoing efforts in a number of states to set up programs to retrofit existing systems to address clean-air standards."

"I think the scope of the provision is subject to question," said Ben Grumbles, EPA's acting associate administrator for congressional relations. Basis Bond Finance Hill Clean-air advocates and California officials say the amendment would halt state efforts to reduce emissions from non-road engines, which account for 17 percent of all smog emissions from mobile sources and 44 percent of toxic diesel emissions. They said the amendment could be interpreted to extend the prohibition to state efforts to regulate larger engines.

William Becker, executive director of two associations of state and local air pollution officials.

Those emissions are major contributors to smog and to health problems such as asthma and heart and lung disease.
